By creating an account, accessing, or using ClickBank Command Center, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

Legal Agreement: These Terms constitute a legally binding agreement between you and ClickBank Command Center. Your continued use of the platform signifies your acceptance of any updates or modifications to these Terms.

Multiple Accounts: You may not create multiple accounts for fraudulent purposes or to circumvent account restrictions or limitations.

Accurate Information: You agree to keep your account information current and accurate. Failure to do so may result in suspension or termination of your account.

Account Transfer: You may not transfer, sell, or otherwise convey your account to another person or entity without our prior written consent.

Our platform operates on a subscription-based model. By subscribing to our services, you agree to pay the applicable fees.

Subscription Plans: We offer various subscription plans with different features and pricing. Details of each plan are available on our pricing page.

Free Trial: We may offer a free trial period for new users. At the end of the trial period, your subscription will automatically convert to a paid plan unless you cancel before the trial ends.

Payment Authorization: By providing payment information, you authorize us to charge your payment method for all fees associated with your subscription.

Auto-Renewal: Subscriptions automatically renew at the end of each billing period (monthly or annual) unless you cancel before the renewal date. You will be charged the then-current subscription rate.

Price Changes: We reserve the right to modify our pricing. We will provide you with at least 30 days' notice of any price increases. Continued use after the price change constitutes acceptance.

Billing Disputes: If you believe you have been incorrectly charged, please contact us within 30 days of the charge. We will investigate and, if appropriate, issue a refund.

Taxes: All fees are exclusive of applicable taxes. You are responsible for paying any taxes associated with your subscription.

You may cancel your subscription at any time through your account settings.

Cancellation Process: To cancel, go to Account Settings > Billing > Cancel Subscription. Your cancellation will be effective at the end of your current billing period.

Access After Cancellation: Upon cancellation, you will continue to have access to paid features until the end of your current billing period. After that, your account will revert to a free tier (if available) or be suspended.

Refund Policy: We offer a 30-day money-back guarantee for your first subscription payment. If you cancel within 30 days of your initial purchase, you will receive a full refund.

No Partial Refunds: Except for the 30-day money-back guarantee, we do not provide refunds or credits for partial subscription periods. If you cancel mid-billing cycle, you will not receive a refund for the unused portion.

Downgrade: If you downgrade your subscription plan, the change will take effect at the start of your next billing cycle. No refunds or credits will be issued for the difference.

Account Termination: If we terminate your account for violation of these Terms, you will not be entitled to any refund of prepaid subscription fees.

You may use our platform only for lawful purposes and in accordance with these Terms.

Permitted Uses: You may use our platform to: (1) connect and analyze your ClickBank accounts, (2) generate reports and analytics, (3) manage your ClickBank business activities, and (4) access support and documentation.

Prohibited Activities: You agree not to:

• Use the platform for any illegal or unauthorized purpose

• Violate any applicable laws or regulations

• Infringe upon the intellectual property rights of others

• Upload or transmit viruses, malware, or other malicious code

• Attempt to gain unauthorized access to our systems or other users' accounts

• Interfere with or disrupt the platform or servers

• Use automated systems (bots, scrapers) to access the platform without permission

• Reverse engineer, decompile, or disassemble any part of the platform

• Remove or modify any copyright, trademark, or proprietary notices

• Share your account credentials with others

• Resell or redistribute our services without authorization

• Use the platform to spam or send unsolicited communications

API Usage: If you use our API, you must comply with our API Terms and rate limits. Excessive or abusive API usage may result in suspension.

Data Mining: You may not use data mining, robots, or similar data gathering methods to extract data from our platform in bulk.

Our platform allows you to connect your ClickBank accounts and store associated data.

Your Data: You retain all rights to your ClickBank data and any other information you provide to or through our platform.

License to Us: By using our platform, you grant us a limited, non-exclusive, royalty-free license to access, use, and process your data solely to provide and improve our services.

Data Accuracy: You are responsible for the accuracy and legality of the data you connect to our platform. We are not responsible for any errors or omissions in your ClickBank data.

Data Backup: While we regularly back up data, you are responsible for maintaining your own backups of important data. We are not liable for data loss.

Data Export: You may export your data at any time in various formats (CSV, Excel, JSON). We do not charge fees for data export.

Data Deletion: Upon account deletion, we will delete your data in accordance with our Privacy Policy. Some data may be retained for legal or operational purposes.

Our platform and all its content, features, and functionality are owned by ClickBank Command Center and are protected by intellectual property laws.

Our Rights: All rights, title, and interest in and to the platform, including all software, text, graphics, logos, images, and other materials, are our exclusive property or that of our licensors.

Trademarks: ClickBank Command Center, our logo, and related marks are our trademarks. You may not use our trademarks without our prior written permission.

Limited License: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our platform for your personal or internal business purposes, subject to these Terms.

Service Availability: We are not responsible for the availability, performance, or functionality of third-party services. Changes to third-party APIs may affect our platform's functionality.

No Endorsement: Our integration with or links to third-party services do not constitute an endorsement of those services.

AS-IS Basis: Our platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

No Guarantee: We do not guarantee that our platform will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any content or data.

ClickBank Data: We are not responsible for the accuracy of data provided by ClickBank or any discrepancies between our platform and ClickBank's official reports.

Business Results: We make no guarantees about the results you may achieve through use of our platform. Your success depends on many factors beyond our control.

Limitation of Liability: To the maximum extent permitted by law, ClickBank Command Center shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising from or related to your use of the platform.

Maximum Liability: Our total liability to you for all claims arising from or related to your use of the platform shall not exceed the amount you paid us in the 12 months preceding the claim.

Jurisdictional Limitations: Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such cases, our liability will be limited to the maximum extent permitted by law.

Force Majeure: We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or internet/telecommunications failures.

You agree to indemnify, defend, and hold harmless ClickBank Command Center, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from or related to:

• Your use of the platform

• Your violation of these Terms

• Your violation of any rights of another party

• Your violation of any applicable laws or regulations

• Your ClickBank data or other content you provide

• Unauthorized use of your account

Defense of Claims: We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you will cooperate with us in asserting any available defenses.

Notification: You must promptly notify us of any claim subject to indemnification and provide reasonable assistance in our defense of the claim.

Either party may terminate this agreement at any time.

Your Right to Terminate: You may terminate your account at any time by canceling your subscription or deleting your account through account settings.

Our Right to Terminate: We may suspend or terminate your account immediately, without prior notice, if:

• You violate these Terms

• You engage in fraudulent or illegal activities

• Your account poses a security risk

• You fail to pay applicable fees

• You use the platform in a manner that could harm us or other users

Effect of Termination: Upon termination, your right to access and use the platform will immediately cease. You will lose access to your account and any data stored on our platform.

Data Retrieval: You should export any data you wish to retain before terminating your account. After termination, we are not obligated to provide access to your data.

Surviving Provisions: The following sections survive termination: Intellectual Property Rights, Disclaimers, Limitation of Liability, Indemnification, and Dispute Resolution.

No Refunds: Except as provided in our refund policy, termination does not entitle you to any refund of prepaid fees.

Informal Resolution: Before filing a claim, you agree to contact us at legal@mydigistudio.com to attempt to resolve the dispute informally. We will attempt to resolve disputes in good faith.

Binding Arbitration: If we cannot resolve a dispute informally, you agree that any dispute arising from or relating to these Terms or your use of the platform will be resolved through binding arbitration rather than in court, except where prohibited by law.

Arbitration Rules: Arbitration will be conducted under the rules of the American Arbitration Association (AAA). The arbitration will take place in [Your Jurisdiction] or via video conference.

Class Action Waiver: You agree to resolve disputes with us on an individual basis only. You may not bring claims as part of a class action, consolidated proceeding, or representative action.
